SSDT consults on standard of proof

Following the decision of the Solicitors Disciplinary Tribunal (SDT) in England and Wales to move to the civil standard of proof, the Scottish Solicitors’ Discipline Tribunal (SSDT) is now also consulting on the standard of proof which it applies in professional misconduct cases.

As is currently the case in England and Wale, the SSDT applies the criminal standard of proof. However, it is inviting the views of of the Scottish legal profession as to whether it should move to the civil standard and if so, whether this should be implemented by way of a tribunal rule.

Full details of the consultation can be found on the SSDT website and interested parties should submit their comments using the response form provided to enquiries@ssdt.org.uk by the closing date, 4pm 21 June 2019.
